These Terms of Service (“Terms”) govern your access to and use of the SureBright Anywhere platform (the “Platform”), operated by SureBright Technologies Inc. (“SureBright,” “we,” “our,” or “us”).
By accessing the Platform or purchasing a warranty plan through it, you consent to be bound by these Terms.
We may update these Terms at any time. Continued use of the Platform constitutes acceptance of any changes.
2. What SureBright Anywhere Provides
SureBright Anywhere allows customers to purchase warranty plans for products bought from any retailer and provides protection across 60+ product categories.
The Platform acts as a technology platform that helps you manage your warranty purchase history, contract details, and related information.
- Warranty plans are service contracts, not product sales.
- Coverage is provided and fulfilled by licensed third-party insurers and administrators.
3. Eligibility and Customer Responsibilities
By using the Platform, you confirm that you have the legal capacity to enter into a contract and that the information you provide is accurate and complete.
You agree to:
- Provide correct product details when purchasing or registering a plan.
- Retain proof of purchase for the products you protect.
- Use the Platform only for lawful purposes.
Misrepresentation may result in:
- Claim denial.
- Cancellation of your warranty.
- Other legal action where applicable.
4. Warranty Plans and Coverage
Each warranty plan includes its own terms, exclusions, coverage limits, and claim procedures, which are made available at the time of purchase.
Coverage may include repair, replacement, or reimbursement, subject to the plan terms.
Coverage begins after a successful purchase is confirmed. Certain products, conditions, or pre-existing issues may be excluded.
SureBright reserves the right to modify plans, reject products that don't meet eligibility criteria, or update its product offering.
5. Pricing and Payment
All prices and applicable taxes are shown to you before checkout. By completing a purchase, you authorize us (or our payment processor) to charge the payment method provided.
SureBright may:
- Update pricing for future purchases.
- Cancel a plan in the event of fraud, non-payment, or material misrepresentation.
6. Claims Process and Fulfillment
Claims are processed according to the documentation requirements outlined in your plan, which may include receipts, photographs, or diagnostic reports.
- Claims decisions are made by licensed third-party administrators and insurers.
- SureBright does not guarantee claim approval.
7. Relationship with Retailers and Manufacturers
SureBright is not responsible for product defects, retailer return or exchange policies, or any manufacturer warranties.
All product-related issues must be handled with the original seller or manufacturer.
8. Acceptable Use
You agree not to:
- Submit false or fraudulent claims.
- Engage in fraud, abuse, or misuse of the Platform.
- Interfere with the operation, security, or integrity of the Platform.
- Reverse engineer, scrape, or copy any part of the Platform.
Violations may result in suspension or termination of your access.
9. Privacy and Data Use
Your data is handled in accordance with our Privacy Policy. We use your information for:
- Claims processing.
- Fraud detection.
- Analytics, marketing communication, and service improvement.
10. Intellectual Property
All content, software, design, and technology on the Platform are owned by SureBright or its licensors.
You may not copy, reproduce, distribute, or use our branding without our prior written permission. Violations may lead to suspension or termination.
11. Disclaimers
The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law, SureBright disclaims all warranties, including:
- Merchantability.
- Fitness for a particular purpose.
- Non-infringement.
We do not guarantee uninterrupted availability or error-free operation.
12. Limitation of Liability
We are not liable for indirect, incidental, special, or consequential damages arising from your use of the Platform.
Our total aggregate liability is limited to the amount you paid for the relevant warranty plan.
13. Indemnification
You agree to indemnify and hold SureBright harmless from claims arising out of your misuse of the Platform, your breach of these Terms, or any false information you submit.
14. Termination
We may suspend or terminate your access if you violate these Terms or if we suspect fraudulent activity.
Existing valid warranties remain in effect, subject to their own plan terms.
15. Service Contracts Compliance
For U.S. customers, warranty plans are regulated as service contracts under applicable state laws and are backed by licensed insurers.
You typically have the right to cancel and receive a full refund within a free-look period (often 10–30 days), depending on your state. Certain states require specific contractual language and consumer protections that override anything inconsistent in these general Terms.
16. Arbitration and Dispute Resolution (U.S.)
Disputes may be resolved through binding arbitration under AAA (American Arbitration Association) rules.
You waive participation in class actions where legally permitted. Some states limit the enforceability of arbitration clauses; in those cases, applicable law controls.
17. Governing Law
These Terms are governed by the laws of the State of Texas, unless overridden by mandatory consumer protection laws in your state.
18. Compliance with Laws
SureBright complies with applicable service contract regulations, consumer protection laws, and data privacy laws, including the California Consumer Privacy Act (CCPA).
19. Miscellaneous
These Terms constitute the entire agreement between you and SureBright.
If any provision is held invalid, the remaining provisions continue in full effect. Failure to enforce any provision does not constitute a waiver of our rights.
